
Why you must have a Fire Risk Assessment
Overview
A fire risk assessment is a methodical examination of your premises in order to evaluate whether a fire could start and cause harm. The Regulatory Reform (Fire Safety) Order 2005, which came into effect on 1st October 2006, applies to the majority of non-domestic premises. If you are using any part of your premises commercially (even if this is just renting out a room in your house) you will need to have a fire risk assessment. The legislation places certain obligations on the ‘Responsible Person or Duty Holder’ for the premises; that includes carrying out a suitable and sufficient fire risk assessment by a competent person.
The ‘Responsible Person’ is typically the owner and any other person who may have control of any part of the premises, e.g. occupier, or managing-agent. It is perfectly possible to do your own fire risk assessment but this should only be done if you feel you are able to do so. A competent person in this respect is someone who has the necessary training, experience and knowledge to undertake the task. Not having a fire risk assessment is an offence and the Local Fire Authority have a raft of powers at their disposal for those parties who do not conform to the regulations.
